There is often confusion between the terms ‘100% compensation’ and ‘no win no fee’. ‘No win no fee’ means that if a solicitor is unable to obtain compensation for you then they will cover the costs themselves, meaning you won’t be out of pocket, despite being unsuccessful. However, often when a law firm offers this, but does not offer 100% compensation, you can expect to lose a portion of your settlement to your solicitors. This can be done because under English Law, solicitors can recover their fees from the other party, often an insurance company, in a successful case. This payment is totally independent from your compensation amount and will be arranged between the two parties without you having to concern yourself about it.

The only exceptions to this offer are when you make a claim with the Motor Insurers’ Bureau (MIB)[link to Uninsured drivers page] or Criminal Injuries Compensation Authority (CICA)[link to criminal injury page]. The MIB deal with road traffic accident claims in which the responsible party is either uninsured or unable to be traced. The CICA deal with most criminal injury claims, as usually the guilty party does not have the means to pay compensation themselves and does not have sufficient insurance to deal with these types of claims. Both of these organisations are public bodies and therefore do not cover the legal fees of the victim’s solicitors. However, you will be told in detail if this is the case during your initial consultation with us.
